Terms of Service

1. Agreement to Terms

These Terms of Service (“Terms”) constitute a legally binding agreement between you and JobGrove LLC (“JobGrove,” “we,” “us,” or “our”) governing your access to and use of the JobGrove platform, including app.job-grove.com and job-grove.com (collectively, the “Service”).

By creating an account or using the Service, you confirm that you are at least 18 years old, have the legal authority to enter into this agreement on behalf of yourself or your business, and agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Description of Service

JobGrove is a field service management platform designed for trade businesses including landscaping, lawn care, and related services. The Service includes tools for job scheduling, customer management, invoicing, route optimization, team management, and SMS notifications.

JobGrove is a business-to-business (B2B) platform. By using it, you represent that you are using it for legitimate business purposes.

3. Accounts and Registration

To use JobGrove you must create an account. You agree to:

  • Provide accurate, complete, and current information during registration
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access to your account
  • Be responsible for all activity that occurs under your account

You may not share your account credentials with third parties or create accounts on behalf of others without their consent. JobGrove reserves the right to suspend or terminate accounts that violate these Terms.

4. Subscription Plans and Billing

4.1 Plans

JobGrove offers the following subscription tiers: Starter, Pro, and Business. Each plan includes a 7-day free trial. Plan features and pricing are described at job-grove.com and are subject to change with 30 days notice.

4.2 Billing

Subscriptions are billed monthly in advance. Payment is processed by Stripe, Inc. By providing payment information, you authorize JobGrove to charge your payment method on a recurring basis until you cancel. All fees are in US dollars and are non-refundable except as required by law or as described in Section 4.4.

4.3 Free Trial

New accounts receive a 7-day free trial with full access to the platform. No credit card is required to start a trial. At the end of the trial period, continued use requires a paid subscription. We reserve the right to modify or discontinue free trial offers at any time.

4.4 Cancellation and Refunds

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period. We do not provide prorated refunds for unused time within a billing period. If you cancel within 7 days of your first paid charge and have not heavily used the Service, contact us at [email protected] and we will review refund requests on a case-by-case basis.

4.5 Price Changes

We reserve the right to change subscription pricing with 30 days written notice. Price changes will not affect your current billing period. Continued use of the Service after a price change constitutes acceptance of the new pricing.

5. Acceptable Use

You agree not to use JobGrove to:

  • Violate any applicable law or regulation
  • Send unsolicited commercial communications (spam)
  • Infringe on the intellectual property rights of others
  • Upload or transmit malicious code, viruses, or harmful content
  • Attempt to gain unauthorized access to our systems or other users’ accounts
  • Use the Service to conduct fraudulent activity
  • Resell or sublicense the Service without written authorization from JobGrove
  • Scrape, crawl, or systematically extract data from the platform
  • Interfere with or disrupt the integrity or performance of the Service

JobGrove reserves the right to investigate and take appropriate action against any violation of these provisions, including suspending or terminating your account without notice.

6. Your Data and Content

6.1 Ownership

You retain full ownership of all data, content, and information you submit to JobGrove (“Your Content”), including your customer lists, job records, invoices, and business information. JobGrove does not claim any ownership rights over Your Content.

6.2 License to JobGrove

By using the Service, you grant JobGrove a limited, non-exclusive license to host, store, and process Your Content solely for the purpose of providing the Service to you. We do not use Your Content for any other purpose.

6.3 Data Portability

You may export your data at any time from within the platform. Upon account cancellation, your data remains accessible for 90 days before permanent deletion.

6.4 Responsibility for Customer Data

You are solely responsible for the accuracy and legality of the customer data you enter into JobGrove, including obtaining any required consent from your customers for SMS communications sent through the platform.

7. SMS Communications

JobGrove enables businesses to send SMS notifications to their customers and crew members via Twilio. By using this feature, you agree to:

  • Only send messages to recipients who have provided their consent
  • Include opt-out instructions (STOP) in all messages as required by law
  • Comply with the Telephone Consumer Protection Act (TCPA) and all applicable regulations
  • Not use the SMS feature for unsolicited marketing or spam

JobGrove is not liable for SMS messages sent by businesses using the platform that violate applicable law. You agree to indemnify JobGrove for any claims arising from your SMS communications.

8. Intellectual Property

The JobGrove platform, including its design, code, trademarks, logos, and content created by JobGrove (excluding Your Content), is the exclusive property of JobGrove LLC and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the Service without our express written permission.

9. Third-Party Integrations

JobGrove integrates with third-party services including Stripe, Twilio, Google Maps, QuickBooks, and Supabase. Your use of these integrations is subject to the respective third-party terms of service. JobGrove is not responsible for the availability, accuracy, or conduct of third-party services.

10. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. JOBGROVE DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, JOBGROVE LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. IN NO EVENT SHALL JOBGROVE’S TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO JOBGROVE IN THE 12 MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify, defend, and hold harmless JobGrove LLC and its officers, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from your use of the Service, Your Content, your violation of these Terms, or your violation of any third-party rights.

13. Termination

Either party may terminate this agreement at any time. JobGrove may suspend or terminate your access immediately and without notice if you violate these Terms, engage in fraudulent activity, or if we are required to do so by law. Upon termination, your right to use the Service ceases immediately. Sections 6, 8, 10, 11, and 12 survive termination.

14. Governing Law and Disputes

These Terms are governed by the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved exclusively in the state or federal courts located in Broward County, Florida. You waive any objection to jurisdiction or venue in such courts.

Before filing any legal action, both parties agree to attempt to resolve disputes informally by contacting [email protected]. If the dispute is not resolved within 30 days, either party may pursue formal legal action.

15. Changes to Terms

We may update these Terms at any time. We will notify you of material changes by email or through the Service at least 30 days before they take effect. Your continued use of JobGrove after the effective date constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must discontinue use and cancel your subscription.
